Creator's Hub - Terms and Conditions

Welcome to the MOSH Creator’s Hub, a co-creation and collaboration initiative developed by MOSH Central. These Terms and Conditions (“Terms”) govern your participation as a contributor in the MOSH Creator’s Hub (“Creator’s Hub,” “we,” “our,” or “us”). By joining the Creator’s Hub, you (“you,” “Creator,” “participant”) acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. Purpose of the Creator’s Hub

The MOSH Creator’s Hub (“the Hub”) is a voluntary feedback and engagement initiative designed to invite creators, entrepreneurs, and members of the digital community to participate in product development through feedback, surveys, suggestions, and co-creation activities. Members of the Hub contribute ideas to help shape MOSH Central’s future resources, tools, guides, and offerings. Participation is free and voluntary, and no compensation is guaranteed unless otherwise specified in writing.

2. Eligibility

Participants must be 18 years of age or older. By applying, you confirm that all information provided is accurate and truthful. MOSH Central reserves the right to deny or revoke membership at its sole discretion.

3. Nature of Participation

Participation in the Hub may include:

  • Completing surveys or questionnaires

  • Submitting feedback or suggestions

  • Participating in interviews or usability tests

  • Previewing unreleased digital content

  • Providing testimonials, quotes, or case studies

Participation does not establish an employment, agency, or contractor relationship between you and MOSH Central.

4. Ownership of Ideas & Feedback

By participating and submitting feedback, ideas, suggestions, content, testimonials, or proposed improvements (collectively, “Contributions”), you agree to the following terms:

  • Intellectual Property Assignment: All Contributions made by participants become the exclusive intellectual property of MOSH Central unless otherwise agreed in writing. You agree to waive any claim to copyright, authorship, or moral rights over any Contribution provided through the Creator’s Hub.

  • License Grant: You grant MOSH Central a perpetual, irrevocable, royalty-free, transferable, sublicensable, worldwide license to use, reproduce, modify, edit, publish, distribute, translate, publicly display, and incorporate your Contributions into existing or future products, communications, marketing campaigns, and offerings in any format or medium.

  • No Compensation or Recognition: You acknowledge and agree that you will not receive royalties, licensing fees, commissions, or public recognition for your Contributions unless explicitly promised in writing by MOSH Central for a specific project or campaign.

  • Retention of Personal IP: If you submit proprietary, copyrighted, or protected material (such as a business name, brand identity, or logo), ownership of that intellectual property remains with you. MOSH Central will not claim ownership or reuse such protected material for commercial or creative purposes without your express, written permission.

  • Collaborative Works Disclaimer: Any Contributions made as part of collaborative efforts (e.g., product beta feedback or naming suggestions) are considered co-created intellectual property owned solely by MOSH Central unless a separate agreement states otherwise.

  • Waiver of Claims: You hereby agree to irrevocably waive any claims related to similarity of current or future MOSH Central offerings to ideas submitted. MOSH Central is under no obligation to implement or act upon any Contribution received.

5. Confidentiality & Early Access

As a Creator’s Hub member, you may gain access to confidential information, trade secrets, internal development materials, or unreleased products (collectively, “Confidential Content”) ahead of public availability. By participating, you agree to the following terms:

  • Non-Disclosure Obligation: You must not share, forward, copy, distribute, publicly or privately display any Confidential Content (including images, videos, downloadable files, discussion threads, surveys, beta content, or unreleased product previews) without prior written permission from MOSH Central.

  • Private Sharing Prohibited: You may not transmit Confidential Content to individuals, communities, online forums, social media platforms, private chats, or third parties under any circumstance.

  • No Derivative Use: You may not copy, mimic, reverse engineer, decompile, extract, or create derivative works from unreleased materials you access via the Creator’s Hub.

  • Ownership of Confidential Content: All Confidential Content remains the sole intellectual property of MOSH Central. Access is granted for the sole purpose of providing feedback or participating in co-creation. No ownership, license, or usage rights are transferred.

  • Permitted Sharing: If MOSH Central explicitly authorizes a limited release of Confidential Content for promotional or community-building purposes (e.g., sneak peeks, testimonials), you must follow all provided usage instructions and attribution requirements.

  • Violation Consequences: Breach of this clause may result in:

    • Immediate removal from the Creator’s Hub

    • Revocation of access to unreleased content

    • Disqualification from promotional incentives or affiliate eligibility

    • Legal action for damages, including pursuit of injunctive relief

  • Survivability: These confidentiality obligations survive termination of your participation in the Creator’s Hub.

6. Use of Names, Brands, or Identities

If you choose to share your name, brand identity, creator handle, or online persona as part of a testimonial, quote, or co-creation effort, you hereby grant MOSH Central unrestricted permission to use that identity in connection with marketing and communications. No identity will be used without consent.

7. Incentives, Discounts & Referral Codes

Select campaigns may include limited-time incentives (such as coupon codes, digital rewards, or premium access) as a thank-you for participation. These rewards:

  • Are subject to change or cancellation without notice

  • May be limited in quantity or restricted to specific audiences

  • Cannot be exchanged for cash unless otherwise noted

  • Are not guaranteed for every campaign or survey

Abuse of incentive programs (e.g., fraudulent referrals, discount sharing, or multiple form submissions) may result in disqualification.

8. Data Privacy & Communications

By joining the Hub, you agree to receive communications related to:

  • Feedback opportunities and surveys

  • Early access invitations

  • Program updates and Creator’s Hub news

  • Incentive distribution and follow-up

Your contact information will never be sold or shared. See our full Privacy Policy for details on how your data is used and stored. You can unsubscribe or opt out at any time.

9. Removal or Termination

MOSH Central reserves the right to remove you from the Creator’s Hub at any time, with or without cause, including for:

  • Violation of these Terms

  • Abuse of community guidelines or survey instructions

  • Misuse of incentives or referral codes

10. Jurisdiction & Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Vancouver, BC.

11. Limitation of Liability

MOSH Central shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in the Creator’s Hub or use of any materials provided through the program.
